Controlling Contractors

A recent story from the Health and Safety Executive (HSE) has reported that an NHS worker had a ‘lucky escape’ following some work carried out on their boiler by an unregistered boiler engineer. The engineer was not on the gas safe register but was commissioned to take on some work on the boiler. He was not qualified to do this work, and subsequently put the individual and others at risk. The NHS worker is now urging others to ensure they have an annual gas check on their boilers by a registered engineer, particularly ahead of winter when we will all be using our gas more.

The contractor who carried out the original work has since been prosecuted by the HSE. He was given a 40-week suspended sentence, 200 hours community service and ordered to pay costs of £5,263.

What does this mean for your business?

It is essential to ensure that if any contractors are to be allowed to work on the premises, they are properly controlled.

There is a legal obligation to ensure that contractors work in such a way that they do not pose a risk to your employees, visitors, and members of the public and they are not put at risk because of your activities. A procedure should be drawn up for controlling contractors which could be used to assess their competency.

Items to consider:

•          What training and qualifications – is the person qualified and competent to carry out the task? In the incident above the person was a plumber, but not a gas safe registered engineer.

•          Insurance – does the level of insurance cover respective of the task if something went wrong?

•          Risk Assessment and Method Statement – a suitable and sufficient risk assessment should outline all potential risks and hazards that may occur whilst carrying out the task, and the control measures in which will be followed to lower those risks and hazards.

Requesting these details before work commences will enable you to accurately assess the contractor you have commissioned to carry out works and minimise the risk to your business and employees.
